The 5 Common Mistakes Employers Make When Disciplining Staff in South Africa 

Disciplinary action is a necessary part of managing behaviour in the workplace – but too often, employers get it wrong.

Here are five common mistakes that can cost your business more than just time – think CCMA referrals, reputational damage, and poor morale:

1️⃣ Skipping the Procedure

Even if the misconduct seems obvious, employers must follow a fair and lawful process. The Labour Relations Act requires both substantive and procedural fairness – cutting corners could render your case invalid.

2️⃣ Not Giving Proper Notice

Employees must be formally notified of the allegations in writing, with enough time to prepare. Springing a disciplinary hearing on an employee with little warning is a sure path to procedural unfairness.

3️⃣ Failing to Investigate Thoroughly

Acting on hearsay or assumptions is risky. A proper preliminary investigation should always take place to establish whether there’s a case to answer before proceeding to a formal hearing.

4️⃣ Using the Wrong People

Using a manager or HR representative who is too close to the situation to chair the hearing can create bias. Always appoint a neutral and trained chairperson who understands the process and the law.

5️⃣ Overreacting or Being Inconsistent

Sanctions must be appropriate, consistent, and proportionate to the offence and to how similar past matters have been handled. Dismissal isn’t always the answer – context matters.
